Child support is an obligation for any individual who has had a child but is no longer in a relationship with the other parent. New Jersey believes that children should not be affected financially by the fact that they are not raised in a traditionally “intact family,” in which both biological parents reside in the same home. While both parents have a financial obligation to contribute to the support of their children, the parent with whom the children primarily reside is typically the recipient of child support.
Generally, child support for minor children is calculated using the New Jersey Child Support Guidelines computer program. The factors relevant to the calculation of Child Support include, but are not limited to:
- The Incomes of the Parties (Either Actual or Imputed)
- The Alimony Paid or Received by A Party
- The Amount of Overnight Parenting Time Exercised by Each Parent
- The Cost of Providing Health Insurance for The Child(ren)
- Work-Related Childcare Expenses, and
- Government Benefits Received by Either Parent or Any Child
In situations where the parties have substantial incomes, or where an unemancipated child attends college or other post-secondary education away from both parents’ homes, the Child Support Guidelines may not be applicable.
